This study concerns the relationship between the Internet and the Law of Evidence, and specifically, the role of online posts and electronic communication as evidence in civil litigation in light of the rules for the protection of Personal Data pursuant to the new European Regulation 679/2016. The book attempts a thorough analysis of the concept of processing personal data in civil litigation and when it is considered unlawful, starting with an in-depth analysis of electronic communication and online posts as mechanical representations under the Code of Civil Procedure, moving on to the fundamental delineation of the concept of public space, and concluding that it is not always clear in advance when information is public on the internet. In this context, based on theoretical and jurisprudential approaches to date, it analyzes when electronic communication and online posts can be used as evidence without violating the principles of personal data protection and what criteria should be considered for characterizing information on the internet as "public" or "private".
